A critical analysis of Kelsen’s theory leads to a broad concept of custom, which covers diverse types of customary norms, where the always required conviction of legal bindingness depends on different types of factual and normative reasons. In it we should include a strict concept of custom or legal usage, derogating custom, custom of general international law, custom that establishes an unwritten constitution, custom that establishes a new written constitution, judicial custom which creates a rule of precedent and custom newly (...) expressed in the judicial application of customary rules. The basic norm could be formulated as a constitutive norm: ‘If the norms created through the first historical constitution are effective, then the first historical constitution are valid.’ It is thus a customary constitutive rule that recognizes the first historical constitution as valid law. Norms which establish sources of law are constitutive rules, they can be customary norms or legislated norms, but if they are legislated, they have their validity recognized by, directly or indirectly, a constitutive customary norm. By using a broad concept of custom as a conventional practice, Hart implies that general recognition of a customary rule, together with the practice that accompanies it, are sufficient conditions of validity. A doctrine of recognition that is arrived at by means of criticism and a rational reconstruction of the doctrines of Kelsen and Hart regains the essential theses of the traditional recognition theory of Bierling and Engisch. Este trabajo analiza los intentos llevados a cabo por Jeremy Bentham y John Stuart Mill para hacer converger algunos de los principales modelos de fundamentación moral: las éticas de la felicidad, como la aristotélica, o la propia ética utilitarista, las éticas del deber de raíz kantiana y las éticas de los derechos.Si conseguimos “reducir”, en primer lugar, las éticas de los derechos al modelo de la ética del deber, podremos simplificar mucho la cuestión y limitarnos a contrastar este último modelo (...) con las éticas de la felicidad, que a su vez deberían converger en la propia ética de la utilidad. No obstante, y aun reconociendo su gran interés, una convergencia completa entre modelos alternativos se revela como imposible. A pesar de los esfuerzos, sobre todo de John Stuart Mill, no es posible una unificación completa de los planteamientos utilitaristas con los de Aristóteles y Kant. La continuación de la empresa utilitarista de lucha por la unificación teórica en el ámbito del problema de la fundamentación moral encuentra un buen ejemplo actual en la obra de Esperanza Guisán. Rawls says that public reason is the reason of the citizens of a democratic state and takes the Supreme Court in the USA as the exemplar of public reason. It differs from non public reason, which is used e.g., in universities and academic institutions. Rawls contrasts with Kant, which opposes the public reason of the scholar—or the philosopher—, who speaks before the world, to the private reason of state or church officials. The later, once they accept an authority, cannot think (...) by themselves (selbst denken). A closer examination shows that Rawls is not so far from Kant as it seems, because he takes the constitutional judges not as they are, but as they should be. However Rawls still apparently refuses Kant’s unity of reason. Further investigation of the relations between ethical reason, democratic reason and legal reason is needed. Democratic reason is tantamount both to public reason and to legal reason in a modern constitutional state. It is a requirement of ethics but still not identical with ethical reason, since it is possible to accept democratic reason and to argue against it from an ethical point of view. There is just one good way of reasoning, in spite of the constraints that the sources of law and the rules of procedure impose on legal reasoning, compared with ethics. Such constraints are based on the democratic principle, which is again based on ethical reason, which at last both grounds and limits the constraints that law imposes on reason. (shrink)

Does Duncan Kennedy successfully cannibalize jurisprudence? He attempts to do it by demonstrating the inexistence of rightness in legal argumentation. If there is no right legal argument, then there is no right answer in adjudication, adjudication is not a rational enterprise and legal doctrine cannot be said to be a science. It can be shown that skepticism is self-defeating. Duncan Kennedy can avoid self defeat only because he actually believes in a lot of legal arguments. His thesis that judges decide (...) questions of policy without any methodology that distinguishes them from legislators does not hold. Judicial reasoning is subject to constraints that do not affect legislators. It must be based on the sources of law and is limited by rules of procedure. Even when the judges have ‘interstitial’ legislative powers they are, unlike the legislator, bound to fit the system and their decisions are considered in procedure from the perspective of the right answer doctrine. The only work that can convincingly refute the skeptic argument against legal science is the reconstruction of jurisprudence as a scientific enterprise. Such work is beyond the scope of any single paper. The article aims to give some inspirations for such a task. (shrink)

Por meio do estudo bibliográfico e jurisprudencial, buscou-se definir o conteúdo do direito à liberdade de expressão e o seu exercício através da internet. Em seguida, passou-se a examinar o polêmico Inquérito das “fake news” (4.781 DF), do qual emanaram-se decisões colidentes com as garantias conferidas à liberdade de expressão. Le présent article étudie les vues de Fichte sur la filiation divine de Jésus, sa conscience, ses miracles, et son identification avec le Christ. Bien qu’elle reconnaisse que Jésus a eu conscience d’être Fils de Dieu, l’approche fichtéenne esquive l’Incarnation comme telle et se réduit ainsi à une simple jésuslogie. Tout en admettant que le Christ est devenu réalité historique en Jésus, et que le rôle de Jésus – le vrai et grand miracle – demeure unique du point de vue (...) historique, elle estime que le dogme christologique a eu tort de rendre métaphysique l’historique. La « philosophie chrétienne » a-t-elle encore un avenir, ou connaît-elle aujourd’hui sa fin ? Le présent article cherche à répondre de manière nuancée à cette question, après avoir évoqué la naissance du problème et le contexte culturel, rappelé l’essentiel de la fameuse querelle des années 1930, et examiné plusieurs tentatives ultérieures d’articuler la rencontre de la philosophie autonome et de l’expérience chrétienne.

En se centrant sur la façon dont l’ouvrage que Blondel a consacré à l’Esprit chrétien articule le rapport de la philosophie et du christianisme, le présent article s’efforce d’expliciter les traits «classique» de la méthode employée, tout en reconnaissant les limites de sa mise en œuvre.

Dans son Traité d’athéologie, M. Onfray, sans souci de rigueur, se contente de mélanger les poncifs les plus usés de la polémique antireligieuse. À la différence de celui de Nietzsche, son athéisme se rend la tâche trop facile, en ne prenant jamais l’adversaire au sérieux.

Les neuf ouvrages de cette chronique ont été répartis en quatre groupes. Le premier réunit deux livres qui relèvent, en grande partie du moins, de la christologie philosophique. Le second regroupe deux études qui se penchent sur la christologie thomiste. Le troisième recense un ouvrage de M. Fédou sur la christologie qui s’est élaborée en Asie depuis les années 60. La conception fichtéenne de l’Université n’accueille que les parties exégétique et historique de la théologie, et en exclut tout le reste, soit en le renvoyant dans un autre établissement, soit en l’éliminant purement et simplement. En supprimant ainsi l’unité et la méthode herméneutique de la théologie, Fichte ne rapporte cette discipline à la forme philosophique que comme simple « matière ».

This article reviews and discusses emerging evidence suggesting an evolutionarily‐conserved connection between injury‐associated exposure of cytoskeletal proteins and the induction of tolerance to infection, repair of tissue damage and restoration of homeostasis. While differences exist between vertebrates and invertebrates with respect to the receptor(s), cell types, and effector mechanisms involved, the response to exposed cytoskeletal proteins appears to be protective and to rely on a conserved signaling cassette involving Src family kinases, the nonreceptor tyrosine kinase Syk, and tyrosine phosphatases. O presente trabalho tem o objetivo de conectar a teoria criada por Pierre Bourdieu sobre a violência simbólica e o texto de Audre Lorde, The use of anger: women responding to racism do seu livro Sister Outsider; demonstrando a importância do debate sobre a relação entre dominante e dominado a partir do viés racial, tema abordado por ambos autores em seus textos. Com este fito, pretendemos diferenciar os resultados objetivos do ódio, raiva e culpa, bem como o modo que as (...) agressões invisíveis repercutem na vida do oprimido. Tendo como foco o racismo na vida da “mulher de cor” que ainda nos dias de hoje, em uma pirâmide social, se encontram em desvantagem quanto aos demais indivíduos. Faz parte dos objetivos também trazer à tona a reação do oprimido como consequência natural dos séculos de silenciamento, privação e desumanização, analisando os mecanismos institucionais para pacificação social. Aborda o conceito filosófico de rizoma na teorização de Gilles Deleuze e Félix Guattari para desfazer mal entendidos na literatura recente de Ciência da Informação. Explana a dinâmica de criação conceitual na Filosofia e na Ciência, entendendo-as como movimentos entre o virtual e o atual. Em seguida aborda o deslizamento de planos entre Filosofia, Arte e Ciência para ser possível compreender a absorção do conceito filosófico de rizoma pela Ciência da Informação. Apresenta a organização e fluxo da informação pensados inicialmente (...) com a noção de árvore caminhando mais recentemente para a noção de rizoma ou rede. Por fim aproxima as teorizações da filosofia da diferença e da análise de discurso da escola francesa para iluminar ainda mais os mal entendidos sobre a transposição conceitual na Ciência da Informação. ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. La parentalité impose au sujet un travail psychique intense qui s’appuie sur des aspects narcissiques, archaïques, sur l’histoire de la filiation et de la transmission psychique. La parentalité est, avant tout, liée à un processus qui comporte des risques psychiques particuliers face aux événements de vie. Identifier ces enjeux dans la relation parent-enfant et comprendre ce qui est sollicité pour le sujet face à des événements nécessite de remodeler les alliances et de trouver un nouvel équilibre psychique. Dans le cadre (...) d’une recherche clinique, les auteures, impliquées dans un dispositif d’écoute psychanalytique de la parentalité, proposent une discussion quant aux repères cliniques des enjeux qui sous-tendent la relation parent-enfant. Ce questionnement est discuté par deux vignettes cliniques, celle de Maria qui, après son accouchement, expérimente des vécus corporels primitifs projetés sur son bébé et celle de Camila, qui commence son analyse après la tentative de suicide de sa fille. Dans l’ensemble de ces vignettes, on observe une réorganisation de la dynamique psychique et une possibilité de symboliser davantage les modes d’alliance de la dyade parent-enfant. (shrink)

Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. In the management and organization studies literature, a key question to explore and explain is that of the family as an organizational stakeholder, particularly when working-from-home became the “new normal”. Departing from meta-analytic studies on the work-family relation and connecting with scholarly conversation on work-family boundary dynamics, we identify three main narratives. In the _separation narrative,_ work and family belong to different realms, and including the family in the domain of organizational responsibility is seen as pointless. The _interdependence narrative_ stresses (...) that organizations and families are overlapping domains in which it is important to acknowledge that the policies and practices of the former might have an impact on family life, and vice-versa. The _embeddedness narrative_, brought to the fore by the COVID-19 pandemic, sees employment and family as progressively convergent and hybrid work domains. The evolution of employment relations towards increased hybridity of the work situation being embedded in the familial/household context increasingly calls for consideration of the family/household as an integral rather than a peripheral stakeholder. Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. Os últimos anos foram marcados pelo crescimento notável da produção artística/poética em língua de sinais, com a presença cada vez mais efetiva de poetas slamers na cena nacional. O efeito mais direto disso é a vitrinização das interseccionalidade que atravessam as múltiplas identidades surdas, expostas tanto nas performances síncronas das apresentações nos slams, de forma presencial ou virtual, quanto na poesia.doc. A poesia Boneca Invisível utiliza elementos cinematográficos para potencializar sua narrativa e discutir os efeitos mais diretos da violência sofrida (...) por ela, vivido por tantas mulheres, negras, surdas. Fazemos observações de cunho teórico-epistêmico, do feminismo negro em direção ao feminismo negro surdo, e também de interesse prático, que ocupa-se dos meios de produções que são acessados para a composição da poesia surda, suscitando um alargamento conceitual para abarcar textualidades corporais como produções literárias legítimas, além do reconhecimento técnico das ferramentas acionadas e dominadas pela poeta para sua produção textual literária de denúncia.
